Important: By using RoofingReply or receiving messages from a RoofingReply-registered number, you agree to these Terms. Please read them carefully. If you do not agree, do not use the service.

1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and RoofingReply ("Company," "we," "our," or "us") governing your use of the RoofingReply platform, including our website, dashboard, APIs, and automated SMS messaging service (collectively, the "Service").
By (a) registering a phone number with RoofingReply, (b) using our web dashboard or demo, or (c) receiving an automated SMS message from a RoofingReply-registered number in response to a call you placed, you agree to be bound by these Terms and our Privacy Policy.
2. Description of Service
RoofingReply provides an automated missed call lead capture service designed for roofing contractors. The Service works as follows:
- A roofing business ("Business User") registers a Twilio-provided phone number with RoofingReply and configures it to forward calls to their personal phone number.
- When an inbound call to the RoofingReply number is not answered, the Service automatically sends an SMS message to the caller ("End User") on behalf of the Business User.
- The SMS conversation is designed to capture the End User's roofing needs and qualify them as a lead.
- The Business User is notified of the lead and its details via SMS.
- All conversations are stored in the Business User's dashboard.
3. Eligibility
To use RoofingReply as a Business User, you must:
- Be at least 18 years of age
- Be operating a legitimate roofing or home services business
- Have a valid Twilio account and a registered A2P 10DLC phone number (required for production use)
- Agree to comply with all applicable federal, state, and local laws, including the TCPA
RoofingReply is not available to individuals or entities who have been suspended or removed from the Service for violations of these Terms.
4. SMS Messaging Terms
For End Users (Callers Receiving Messages)
By placing a call to a RoofingReply-registered phone number, you understand and agree that:
- You may receive automated SMS messages from the roofing business in response to your missed call.
- Message frequency: Up to 3 messages per missed call incident, plus replies to your responses.
- Message and data rates may apply per your mobile carrier plan.
- To opt out, reply STOP to any message. You will receive one confirmation message and no further messages will be sent.
- To request help, reply HELP.
- Opting out via STOP does not affect your ability to contact the business through other means.
For Business Users (Roofers Using the Service)
By using RoofingReply to send SMS messages, you agree to:
- Only use the Service for legitimate follow-up with individuals who have called your registered business number.
- Comply fully with the TCPA, CAN-SPAM Act, and all applicable state messaging laws.
- Complete A2P 10DLC registration through Twilio before sending messages to customers at scale.
- Not use the Service to send spam, unsolicited marketing messages, or messages unrelated to roofing services.
- Honor all STOP opt-outs immediately and permanently.
5. Business User Obligations
As a Business User, you are solely responsible for:
- Ensuring your use of the Service complies with all applicable laws in your jurisdiction.
- Maintaining accurate business information associated with your RoofingReply account.
- Keeping your Twilio credentials and RoofingReply access credentials secure.
- All communications sent through the Service on your behalf — RoofingReply acts as a technology provider, not a party to those communications.
- Obtaining and maintaining any required licenses, registrations, or permits required by your state to operate a roofing business or send commercial SMS messages.
- Paying all applicable Twilio charges for calls and messages processed through your account.
6. Prohibited Uses
You may not use RoofingReply to:
- Send spam, unsolicited commercial messages, or messages to individuals who have not called your registered number
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity
- Violate any applicable law or regulation, including TCPA, FCC regulations, or state do-not-call laws
- Transmit any harmful, offensive, fraudulent, or deceptive content
- Interfere with or disrupt the Service or servers or networks connected to the Service
- Attempt to gain unauthorized access to any portion of the Service
- Use the Service for any purpose other than legitimate roofing business lead capture
Violation of these prohibitions may result in immediate termination of your account and may be reported to appropriate authorities.
7. Intellectual Property
The RoofingReply platform, including its software, design, text, graphics, and all other content, is the property of RoofingReply and is protected by copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose. You may not copy, modify, distribute, sell, or lease any part of the Service, or reverse engineer or attempt to extract the source code of the software.
You retain ownership of any data you input into the Service, including your business information and customer lead data.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Service will be uninterrupted, error-free, or completely secure
- SMS messages will be delivered successfully to all carriers or devices
- The Service will meet your specific business requirements
- Any leads captured through the Service will result in business conversions
SMS delivery is subject to carrier availability and compliance with A2P 10DLC registration requirements. RoofingReply is not responsible for message filtering or blocking by mobile carriers.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ROOFINGREPLY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- Your use of or inability to use the Service
- Any unauthorized access to or use of our servers or your personal or business data
- Any interruption or cessation of transmission to or from the Service
- Any TCPA violations arising from your use of the Service in violation of these Terms
In no event shall RoofingReply's aggregate liability exceed the greater of (a) $100 or (b) the amounts paid by you to RoofingReply in the twelve months preceding the claim.
10. Indemnification
You agree to indemnify, defend, and hold harmless RoofingReply and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:
- Your access to or use of the Service
- Your violation of these Terms
- Your violation of any applicable law, including TCPA violations
- Any claim by a third party arising from SMS messages sent through your RoofingReply account
11. Termination
We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, with or without notice, including if we believe you have violated these Terms or applicable law.
You may discontinue use of the Service at any time. Upon termination, your right to use the Service will immediately cease.
Provisions that by their nature should survive termination — including Sections 7, 8, 9, 10, and 12 — will survive termination of these Terms.
12. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
Any dispute arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration under the rules of the American Arbitration Association, conducted in San Jose, California.
You waive any right to participate in a class-action lawsuit or class-wide arbitration against RoofingReply.
13. Changes to Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page. For significant changes, we will provide notice via email or a prominent notice on our website.
Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.
